1. Scope of Service and Use of the Site

 

Photographic Sports Media Group provides on-location photography services for organizations (Schools, Leagues, Clubs, and Corporate Clients) within the North Texas area.

  • Eligibility: By using this Site, you affirm that you are over the age of 18 or are accessing the site with the full consent and supervision of a parent or legal guardian.

  • Booking and Orders: Any booking, scheduling ("Book Your Picture Day Today"), or purchase of photographic products made through this Site, or associated portals linked from this Site, is governed by these Terms and any specific Service Agreements or Order Forms signed by the client organization.

 

 

2. Intellectual Property and Proprietary Systems

 

The Site and its original content, features, and functionality are and will remain the exclusive property of Photographic Sports Media Group and its licensors.

  • Website Content: All written content, graphic design, logos, and digital displays on the Site are protected by copyright, trademark, and other laws of both the United States and foreign countries.

  • Photographic Works: All photographs, composites, and digital imagery displayed on the Site are the exclusive intellectual property of Photographic Sports Media Group. They are protected under copyright law and may not be copied, reproduced, distributed, or used for any commercial purpose without our express written permission.

  • Patented Technology: You acknowledge that Photographic Sports Media Group utilizes proprietary and patented mobile lighting methods and apparatuses (including but not limited to U.S. Patent No. US11,567,394 and US11,789,342) in the delivery of our services. Nothing in these Terms grants you any right or license to use, reproduce, or reverse-engineer this patented technology.  

  • Image Use Consent: As stated in our Privacy Policy, we do not use any client images for marketing or advertising materials without the express, opt-in permission of the parents or subjects involved.

 

 

3. Commercial Terms (Bookings, Payments, and Cancellations)

 

These terms govern transactions processed via the Site or in connection with our services:

  • Pricing: All pricing, packages, and investment options displayed on the Site are subject to change without notice and are confirmed only upon signing a formal Service Agreement with the client organization.

  • Payment: Payments for services and/or products are processed through secure third-party payment processors (e.g., Square ). By completing a transaction, you agree to the terms of that payment processor. We are not responsible for errors or security breaches on the part of the payment processor.  

  • Cancellations and Refunds: Policies regarding cancellation of scheduled Picture Days, refunds for product orders, and rescheduling fees are detailed in the specific Service Agreement provided at the time of booking.

 

 

4. Disclaimer and Limitation of Liability

 

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

  • Accuracy of Information (Disclaimer of Responsibility): While we strive for accuracy, the information presented on this Site may contain technical inaccuracies or typographical errors. We do not warrant the completeness, reliability, or accuracy of this information. We are not responsible for any liability arising from your reliance on any information found on the Site.  

  • Service Availability: We do not warrant that the website will operate uninterrupted, securely, or be available at any particular time or location.

  • Liability Cap: In no event shall Photographic Sports Media Group, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

Our Site may contain links to third-party web sites or services (e.g., client portals, social media, payment processors) that are not owned or controlled by Photographic Sports Media Group.

Photographic Sports Media Group has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that Photographic Sports Media Group shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

 

 

6. Governing Law

 

These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. You agree that any legal action or proceeding related to this website shall be brought exclusively in the courts located in North Texas, Texas.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
